What's an Appeal?

It refers to a request made to a higher court after the final judgment has been rendered, asking it to review and, if necessary, reverse the lower court's decision and turn it in the losing party's favor. The losing side must cite legal arguments for why it believes the lower court's decision was incorrect and why the higher court should reverse it. The grounds on which it can be filed are mentioned below:

  • Only grave errors are counted under this provision when a mistake was made during the trial. The applicant must additionally show how the mistake violated his rights.
  • When the verdict is not supported by the evidence, it is far more difficult to prove why it was based on insufficient evidence. As a result of not hearing all of the arguments at the prior trial, the Court of Appeal's decision was not entirely impartial. Most of the courts consider the evidence before deciding the case based on their acceptance of the trial court's verdict.
  • Both the plaintiff and the defendant have the option to file it in civil cases. Unless the ruling was rendered by the highest court, the defendant has the right to appeal. The court is not required to consider all of it because there may be an appealable error, in those cases the appeal may be denied for those reasons.

A LPA is an appeal from a smaller bench of the same court to a larger bench. These are handled in accordance with Section 50(1)(b) of the Arbitration and Conciliation Act, 1996, and must be evaluated in accordance with previously established standards. The single judge bench’s decision may be erroneous due to incorrect information or may even violate the law. Before going to the Supreme Court in these circumstances, the appellant has the option to refer the matter to a bigger bench of the same court. In this way, travelling to the Supreme Court to file a case would not be necessary. When submitted with the High Court, this is known as an intra-court appeal, and when filed with the Supreme Court, it is known as an inter-court appeal.

LPA requires the following documents for the proceeding:

  • Copy of that decision and order that has been certified.
  • High Court certificate in certified copy.
  • Copy of the decree issuing the specified certificate, certified.

The maximum period for filing an inter-court appeal is 30 days and filing an intra-court appeal is 90 days

Letters Patent Appeal is an appeal from a single bench to a larger bench of the same court. Such kind of appeal is dealt with, under Section 50(1) (b) of the Arbitration and Conciliation Act, 1996

It must also be noted that intra-court appeal is not maintainable in cases of criminal nature.
