The Supreme Court has upheld the principle of "One Rank One Pension" for all retired High Court Judges, including Additional Judges, mandating uniform annual pensions of ₹15,00,000 for retired Chief Justices and ₹13,50,000 for other retired Judges. It ruled that previous service as a District Judge must be counted for pension computation and that any break between retirement from the District Judiciary and appointment to the High Court will not impact pension entitlement. The Court also clarified that Judges appointed after the introduction of the National Pension Scheme (2004) are entitled to pension benefits under the High Court Judges Act, with their NPS contributions refunded with interest—while State contributions remain with the government. Moreover, family pension and gratuity cannot be denied to the families of Additional Judges; gratuity should be calculated by adding 10 years to the Judge’s actual service. Retired Judges are also entitled to provident fund, leave encashment, and commutation benefits under the Act.
